Right of Withdrawal for Consumers

Consumers have a statutory right of withdrawal in the case of distance selling contracts.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or self-employed professional activity.

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you, or a third party designated by you who is not the carrier, have taken possession of the goods.

by means of a clear statement declaring your decision to withdraw from this contract.

To meet the withdrawal deadline, it is sufficient for you to send the notification of your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of Withdrawal

If you withdraw from this contract, we shall reimburse you for all payments received from you, including delivery costs, with the exception of any additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us, without undue delay and no later than fourteen days from the day on which we receive notification of your withdrawal from this contract.

For this reimbursement, we shall use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you. In no event will you be charged any fees as a result of this reimbursement.

We may withhold reimbursement until we have received the goods back or until you have provided evidence that you have returned the goods, whichever is the earlier.

You must return or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you notify us of your withdrawal from this contract. The deadline is met if you dispatch the goods before the period of fourteen days has expired.

You shall bear the direct costs of returning the goods.

You are only liable for any diminished value of the goods if such diminished value results from handling the goods other than what is necessary to establish the nature, characteristics and functioning of the goods.

Note on Technical Components

In the case of technical components, in particular engine and vehicle components, installation, assembly or commissioning may go beyond what is necessary to establish the nature, characteristics and functioning of the goods and may result in a diminished value of the goods. In such cases, a corresponding reduction in value may be taken into account when issuing the reimbursement.

Exclusion of the Right of Withdrawal

The right of withdrawal does not apply to contracts for the supply of goods that are not prefabricated and for the manufacture of which an individual choice or specification by the consumer is decisive, or which are clearly tailored to the consumer’s personal needs.

Notice for Entrepreneurs

The right of withdrawal applies exclusively to consumers. Entrepreneurs within the meaning of Section 14 of the German Civil Code (BGB) are not granted a right of withdrawal. Any returns accepted from entrepreneurs are made exclusively on a voluntary basis and only with prior express consent in each individual case.
